The object of this suit is to enforce the lien of the Complainant, County of Montgomery, Virginia, for delinquent real estate taxes against certain real property located in the County of Montgomery, Virginia, described as follows:
Tax Map No. 466-15-41
Account No. 029329
All that certain tract or parcel of land, with the improvements thereon and the appurtenances thereunto belonging, situate, lying and being on the northerly side of Independence Boulevard in the Riner Magisterial District of Montgomery County, Virginia, and described as follows:
All of Lot 41, Vistavia Phase II, as shown on that map prepared by D.P. Marks, CLS, of Marks & Associates, LTD, dated October 17, 1988, Plan T-88-33A, entitled Plat of Vistavia Subdivision, Phase II, of record in the Office of the Clerk of the Circuit Court of Montgomery County, Virginia in Plat Book 15, Page 178, Slide 505; and as more particularly shown on that map prepared by Neal H. Wirt, dated April 6, 1991, Plan No. 91-134, entitled Plat for Jerry J. Powell and Taz C. Powell of Lot No. 41, Phase II, Vistavia Subdivision, of record in said Clerk’s Office in Deed Book 703 at Page 104, and which map reference is made for a more particularly description of the property hereby conveyed.
And being the same real property conveyed by Prudential Relocation, Inc., A Colorado Corporation to Nicholas W. White and Kaitlin K. Hertling by Deed dated December 16, 2008 and recorded on March 16, 2009 in the aforementioned Clerk’s Office as Instrument Number 2009002308.
This description is made subject to all easements, conditions, agreements, restrictions, and reservations of record which affect the property herein described including but not limited to those recorded in Deed Book 342, Page 13; Deed Book 357, Page 559; Deed Book 358, Page 180; Deed Book 363, Page 231; Deed Book 372, Page 127; Deed Book 538, Page 46; Deed Book 597, Page 336; Deed Book 657, Page 171; Deed Book 664, Page 33.
IT APPEARING that an Affidavit has been made and filed stating that due diligence has been used, without effect, to ascertain the identity and location of certain parties to be served, and that any officers, heirs, devisees, and successors in title of the Respondent named herein are made parties Respondent to this action individually and/or by the general description of Parties Unknown, it is hereby
ORDERED that the parties herein and all Parties Unknown and/or whose location cannot be ascertained appear on or before September 14, 2020 in the Clerk’s Office of the Circuit Court of the County of Montgomery, Virginia, and do what may be necessary to protect their interests in this cause.
