The object of this suit is to enforce the lien of the Complainant, County of Montgomery, Virginia, for delinquent real estate taxes against certain real property located in the County of Montgomery, Virginia, described as follows:

All of the certain tract or parcel of land with all improvements thereon and appurtenances thereunto belonging situate, lying and being in the Riner Magisterial District of Montgomery County, Virginia, on the West side of Little River and lying on the East side of the secondary road 710, known as Blue Spring Road, the same being bounded and described as follows:
BEGINNING at an iron pipe stake on the Easterly side of Blue Spring Road (State road 710), near the front of T.W. Simpkins store building; thence with a line of land now or formerly owned by George Pelkey, and continuing with land now or formerly owned by E.T. Showalter, N 89 degrees 28 minutes W 737.3 feet to a stake near and westward from a sink hole, at a corner of land now or formerly of J.E. Meredith; thence with a line of the same N 1 degree 09 minutes E 73.9 feet to a stake at the Southwesterly corner the land now or formerly of Garl Ridpath; thence with a line of the same, S 89 degrees 28 minutes E 663.0 feet to a stake in the center line of Bluespring Road (State road 710); thence S 43 degrees 40 minutes E 105.6 feet, crossing to the East side of said road, to the beginning, and containing 1.143 acres, more or less.
And being the same property conveyed to Dorothy Helen Pelkey from T.W. Simpkins and Doshie Simpkins, husband and wife, by Deed dated September 6, 1955 and recorded in the Montgomery County Circuit Court Clerk’s Office in Deed Book 202 at Page 442 on December 20, 1956.
This description is made subject to all easements, conditions, agreements, restrictions, and reservations of record which affect the property herein described including but not limited to those recorded in Instrument Number 2002009452.

All that certain tract or parcel of land with all improvements thereon and appurtenances thereunto belonging situate, lying and being in the Riner Magisterial District of Montgomery County, Viriginia, more particularly described as follows, to wit:
BEGINNING at an iron stake on the easterly side of Blue Springs Road (State road 710), and on the southerly side of a private roadway, at the northwest corner of the land of now or formerly owned by T. W. Simpkins; thence with three lines of the same, S 5 degrees 00 minutes E 121 feet, crossing said Blue Springs Road (State road 710), to a stake in the old road; thence with said old road, S 20 degrees 15 minutes E 204.6 feet to a stake; thence S 41 degrees 15 minutes E 176.25 feet to a stake at the northeasterly corner of the Roscoe Bond 5-acre parcel; thence with a line of the same, leaving said old road, S 74 degrees 40 minutes W 406 feet to a stake in a hollow, corner of the remaining land now or formerly of E. T. Showalter; thence with a line of the same, N 30 degrees 00 minutes W 603.4 feet to a stake in or near a line of the now or formerly American Pigment Corporation; thence running with or near said line, N 86 degrees 35 minutes E 500.7 feet to the BEGINNING, and containing 4.97 acres;
And being the same property conveyed to George Keith Pelkey and Dorothy P. Pelkey, husband and wife, from George Keith Pelkey and Dorothy P. Pelkey, his wife, by Deed dated November 2, 1977 and recorded in the Montgomery County Circuit Court Clerk’s Office in Deed Book 396 at Page 578 on March 30, 1978.
LESS AND EXCEPT all that certain lot or parcel of land with all improvements thereon and appurtenances thereunto belonging situate, lying and being in the Riner Magisterial District of Montgomery County, Virginia, described as follows:
BEGINNING at a point designated as “E” on the western right of way line of Blue Springs Road (State Road 710), said point of beginning being also the northeast corner of Parcel “B” (now or formerly Bonds) as shown on a Plat prepared by W.A. Davis, CE/LS, dated September 14, 1998, and from said point of beginning in a westerly direction S 76 degrees 30 minutes 00 seconds W 449.30 feet to an iron rod designated as point “B”; thence N 54 degrees 31 minutes 26 seconds E 406.06 feet to point “D” located on the western right of way line of Blue Spring Road (State Road 710) in a southerly direction S 39 degrees 04 minutes 56 seconds E 168.47 feet to the point of beginning, and being a triangular parcel of land, more particularly shown and described on the aforesaid plat; and which was conveyed to Kelly P. Bonds and Regina F. Bonds, husband and wife, by Deed, dated November 7, 2001 and recorded in Montgomery County Circuit Court Clerk’s Office in Deed Book 1274 at Page 241 on April 12, 2002.
LESS AND EXCEPT all that certain lot or parcel of land with all improvements thereon and appurtenances thereunto belonging situate, lying and being in the Riner Magisterial District of Montgomery County, Virginia, described as follows:
BEGINNING at an iron rod located on the western right of way line of Blue Springs Road (State Road 710), and with the western right of way line of Blue Springs Road S 22 degrees 01 minutes 13 seconds E 52.00 feet to an iron rod; thence with a line N 54 degrees 31 minutes 26 seconds E 406.06 feet to an iron rod located on the property line of Dorothy H. Pelkey; thence with the Pelkey line N 24 degrees 42 minutes 02 seconds W 122.00 feet to an iron rod; thence leaving the Pelkey right of way line and with a line N 64 degrees 27 minutes 46 seconds E 401.37 feet to an iron rod located on the western right of way of Blue Springs Road, the point of beginning and being a parcel of land containing 0.7977 acres as shown on a plat entitled “Boundary Line Adjustment” dated January 7, 2004 and prepared by Mathews and Henegar, PLC, which plat sets forth the metes and bound of the property noted on said plat as “Adjusted Area”; and which was conveyed to Kelly P. Bonds and Regina F. Bonds, husband and wife, by Deed, dated January 13, 2004 and recorded in Montgomery County Circuit Court Clerk’s Office as Instrument Number 2004000485 on January 15, 2004.
LESS AND EXCEPT all that certain lot or parcel of land with all improvements thereon and appurtenances thereunto belonging situate, lying and being in the Riner Magisterial District of Montgomery County, Virginia, described as follows:
BEGINNING at an iron rod set on the eastern boundary line of the property, said point of Beginning being on the western right-of-way line of State Route No. 710, commonly known as “Blue Springs Rd”, and from said point of Beginning and with the western right-of-way line of State Route 710, S 22 degrees 01 minute 19 seconds E 201.59 feet to the property line of now or formerly Kelly P. Bonds, et ux; thence, with the Bonds property line in a westerly direction, 397 feet, more or less, to a point located on the eastern boundary line of Parcel #1 being conveyed herein; thence, with the easterly boundary line of Parcel #1 and proceeding in a northerly direction 210 feet, more or less, to a point on the property line of now or formerly Vanderbilt Mortgage; thence, from said point N 77 degrees 44 minutes 23 seconds E 48 feet, more or less, to an iron rod found; thence, with a new line as shown on the hereinafter described Plat and proceeding in an easterly direction 365.87 feet to the point of Beginning, and designated as Area “D” containing 1.6578 acres, more or less, as is more particularly shown and described on a Plat prepared by Mathews and Henegar, Inc. entitled “Boundary Line Relocation Between The Properties Of Dorothy P. Pelkey and Margaret Elizabeth Bonds and Kelly P. Bonds and Regina F. Bonds”, Job No. 400702, dated November 8, 2010 and recorded as Instrument Number 2010010373 in Montgomery County Circuit Court Clerk’s Office.

IT APPEARING that an Affidavit has been made and filed stating that due diligence has been used, without effect, to ascertain the identity and location of certain parties to be served, that the last known addresses for the Respondents herein are as follows: Dorothy Helen Pelkey aka Dorothy P. Pelkey, who is believed to be deceased and whose last known address is unknown; Dorothy Simpkins, who is believed to be deceased and whose last known address is unknown; Brian Pelkey, who is believed to be deceased and whose last known address is unknown; Taylor Ratcliffe, whose last known address is 1970 Palmer Street, Lot 1, Christiansburg, Virginia 24073; Alexis Ratcliffe, whose last known address is 345 Lynn Haven Circle, Vinton, Virginia 24179; Kevin Pelkey, whose last known address is 6009 Blue Springs Road, Hiwassee, Virginia 24347; and that any officers, heirs, devisees, and successors in title of the Respondent named herein are made parties Respondent to this action individually and/or by the general description of Parties Unknown, it is hereby
ORDERED that the parties herein and all Parties Unknown and/or whose location cannot be ascertained appear on or before September 16, 2019 in the Clerk’s Office of the Circuit Court of the County of Montgomery, Virginia, and do what may be necessary to protect their interests in this cause.
