The object of this suit is to enforce the lien of the Complainant, County of Montgomery, Virginia, for delinquent real estate taxes against certain real property located in the County of Montgomery, Virginia, described as follows:
Tax Map No. 059-A A 65
Account No. 017373
All of that certain lot or parcel of land with all improvements thereon and appurtenances thereunto, lying and being in Shawsville Magisterial District, Montgomery County, Virginia, and described as Tax Map Number 059-A A 65, Parcel ID Number 017373 and being 2.24 acres, more or less.
And being the same property conveyed to James F. Simmons from S.B. Henson and Regina F. Henson, his wife, by Deed, dated August 7, 1950 and recorded in the Montgomery County Circuit Court Clerk’s Office in Deed Book 167 at Page 208 on August 11, 1950.
This description is made subject to all easements, conditions, agreements, restrictions, and reservations of record which affect the property herein described including but not limited to those recorded in Deed Book 457 at Page 308.
IT APPEARING that an Affidavit has been made and filed stating that due diligence has been used, without effect, to ascertain the identity and location of certain parties to be served, that the last known addresses for the Respondents herein are as follows: James Frank Simmons aka J. Frank Simmons, who is believed to be deceased and whose last known address is unknown; Helen Simmons, who is believed to be deceased and whose last known address is unknown; Gracie Lenora Simmons Bonds, who is believed to be deceased and whose last known address is unknown; Eloise Russo Simmons Pack, whose last known address is 1421 Fresno Street NW, Roanoke, Virginia 24017; and that any officers, heirs, devisees, and successors in title of the Respondent named herein are made parties Respondent to this action individually and/or by the general description of Parties Unknown, it is hereby ORDERED that the parties herein and all Parties Unknown and/or whose location cannot be ascertained appear on or before June 15, 2020 in the Clerk’s Office of the Circuit Court of the County of Montgomery, Virginia, and do what may be necessary to protect their interests in this cause.
