The object of this suit is to enforce the lien of the Complainant, County of Montgomery, Virginia, for delinquent real estate taxes against certain real property located in the County of Montgomery, Virginia, described as follows:
Tax Map No. 089-A 69
Account No. 019383
All that certain tract or parcel of land lying and being in the Riner Magisterial District of Montgomery County, Virginia, containing ten (10) acres, more or less, fronting 369 feet on “Lee Highway”, and adjoining the properties, now or formerly owned by, Thomas Thornton, D. M. Harman, and others, together with all their right, title and interest in and to any easements and rights of way benefiting said property whether recorded or not.
And being the same real property conveyed to Nettie Lee Thornton and Arthur B. Thornton, brother and sister, from Bessie Mae Thornton, widow, and Nettie (Nellie) Lee Thornton, via Deed dated April 21, 1971 and recorded April 23, 1971 among the records of the Montgomery County Circuit Court Clerk’s Office in Deed Book 310 at Page 343.
This description is made subject to all easements, conditions, agreements, restrictions, and reservations of record which affect the property herein described including but not limited to those recorded in Deed Book 147 at Page 294.
IT APPEARING that an Affidavit has been made and filed stating that due diligence has been used, without effect, to ascertain the identity and location of certain parties to be served, that the last known addresses for the Respondents herein are as follows: Nettie Lee Thornton, who is believed to be deceased and whose last known address is unknown; Debbie Davis, whose last known address is unknown; Arthur B. Thornton, who is believed to be deceased and whose last known address is unknown; Robert Lee Thornton, whose last known address is 300 N. Franklin Street Apt 3, Christiansburg, Virginia 24073; James E. Thornton, whose last known address is 300 N Franklin Street, Lot 6, Christiansburg, Virginia 24073; and that any officers, heirs, devisees, and successors in title of the Respondent named herein are made parties Respondent to this action individually and/or by the general description of Parties Unknown, it is hereby ORDERED that the parties herein and all Parties Unknown and/or whose location cannot be ascertained appear on or before December 27, 2019 in the Clerk’s Office of the Circuit Court of the County of Montgomery, Virginia, and do what may be necessary to protect their interests in this cause.
